Stéphanie Thurber

Stéphanie has over 30 years of experience in intellectual property, technology law, and privacy and data protection. Throughout her career with leading law firms, she has built a distinguished practice in these areas while also acting as a Trademark Agent.

She advises businesses on the protection, commercialization, and strategic use of their intellectual property assets, including copyrights, trademarks, industrial designs, trade secrets, domain names, reserved designations, value-added terms, and geographical indications. Her experience also encompasses the management of trademark portfolios in Canada and internationally. In addition, she represents clients in trademark opposition and expungement proceedings, as well as in intellectual property litigation matters. Her expertise is also leveraged in intellectual property due diligence conducted in connection with mergers and acquisitions, financing transactions, and other corporate matters.

Deeply committed to privacy and data protection issues, Stéphanie has delivered numerous presentations on Québec’s Law 25 and has supported organizations in the implementation of privacy compliance programs. She has contributed to the development of compliance policies and best practices relating to privacy governance, data governance, confidentiality incident management, privacy impact assessments, and filings with Québec’s Commission d’accès à l’information. She holds the Certified Information Privacy Professional/Canada (CIPP/C) designation awarded by the International Association of Privacy Professionals (IAPP).

Her practice also extends to technology, innovation, and digital law. In this capacity, Stéphanie advises clients on the drafting and negotiation of complex commercial agreements, including licensing, technology transfer, SaaS solutions, distribution, services, and research agreements. She also has extensive experience with ancillary agreements such as non-disclosure agreements, non-competition agreements, development agreements, subcontracting arrangements, website hosting agreements, and escrow agreements.

Always attentive to technological developments, Stéphanie has a particular interest in artificial intelligence governance, digital accountability, and cybersecurity, as well as regulated industries such as the production and sale of alcoholic beverages, the application of Québec’s Charter of the French Language, and product labelling requirements.

Before joining Delegatus, Stéphanie practiced with several leading law firms, where she developed a recognized practice in intellectual property, privacy and data protection, and technology law.

Most recently, she was a Partner at Cain Lamarre, where she led the Intellectual Property and Privacy practice groups while practicing as a lawyer and Trademark Agent. Previously, she was a Partner at De Grandpré Chait. She also practiced with Bélanger Sauvé as a lawyer and Trademark Agent.

• Managing international trademark portfolios and other intellectual property assets for clients in a wide range of industries, including apparel, wines, ports and olive oils, teas and herbal products, cycling, and performance data collection and analytics technologies.
• Representing a company before the Trademarks Opposition Board, the Federal Court, and the Federal Court of Appeal in a dispute against a leading bleach manufacturer.
• Assisting automobile dealerships and a pharmaceutical research and regulatory company in complying with privacy and data protection requirements.
• Serving on an access to information and privacy committee for a major national public corporation in the arts and culture sector.
• Advising a live entertainment production company on the clearance and management of rights associated with works used in its productions.
